Group wants part of Proposition 47 that makes date rape drug misdemeanor changed

Lawmakers debated this week the impact of a date rape drug in light of a new law that now makes it a misdemeanor for someone to possess it.

California voters passed Proposition 47 last November which declassifies certain felonies such as shoplifting and drug possession, to misdemeanors.

An unintended consequence of Prop 47 is that it is now a misdemeanor to possess date rape drugs which are powerful sedatives often used in sexual assaults.

Local groups like the Alliance Against Family Violence and Sexual Assault want the law changed.

“I am not interested in taking on the whole proposition, what I am interested in is people not being harmed and it’s absolutely absurd that those class of drugs are a misdemeanor,” said Louis Gill with the Alliance Against Family Violence and Sexual Assault.

Lawmakers say closing Prop 47’s date rape loophole is particularly important due to the growing number of sexual assaults on college campuses.

If passed by the Legislature, harsher sentencing for the possession of date rape drugs would be decided by voters on the 2016 ballot.
