Lawmakers move to override voters on ‘date rape’ drugs

SACRAMENTO, Calif. (AP) — State lawmakers are asking Gov. Jerry Brown to override one portion of the voter-approved Proposition 47, which reduced penalties for some crimes.

They say voters went too far last year when they reduced penalties for possessing so-called “date rape” drugs to misdemeanors. Proposition 47 included the drugs among crimes where penalties were reduced from felonies.

SB333 by Democratic Sen. Cathleen Galgiani of Stockton would make it a felony to possess three of the substances, but only if the owner intends to commit a sex crime. That’s different than the pre-Proposition 47 law.

The sentence would be served in a local jail instead of a state prison, unless the defendant has a conviction for a serious, violent or sex offense.

Senators unanimously approved her bill Thursday, sending it to the governor.
