A drunk policewoman who ‘joked about rape and sex trafficking’ to colleagues has been found guilty of gross misconduct – but will keep her job.

PC Simina Muntean has been given a final written warning about her conduct while working for West Midlands Police.

She appeared before a misconduct hearing held at Lloyd House HQ where she faced two charges of gross misonduct.

In one incident which was proven, PC Muntean was said to have made ‘inappropriate and offensive comments’ about a police colleague at an external course on both April 28 and April 30 in 2018.

She had allegedly become intoxicated while off-duty in a pub and made inappropriate comments whilst in conversation with members of the public, who were aware she was a police officer.

The panel agreed that PC Muntean subsequently returned to a hotel bar where she allegedly repeated the comments to a professional colleague from another police force.

She was said to have called one colleague a “snake” and made another comment where she said: “I am from Romania. I have been trafficked here, they are forcing me to have a*** sex.”

Panel chairman Callum Cowx said they had found PC Muntean guilty of this allegation.

He said: “We have taken the decision that this is gross misconduct. You will be given a final written warning.

“The behaviour was totally unacceptable from a serving officer.

“You made a joke about police rape and human trafficking. Rape and human trafficking is taken very seriously by the police and criminal justice system and your comments were totally unacceptable.”

A second incident where she was alleged to have been drunk while off-duty at Birmingham Airport was unproven.

PC Muntean had reported an assault on a man who she had found with blood pouring from a head wound to an officer on patrol.

She had allegedly got into a dispute with a Sergeant over the handling of the incident and was arrested for drunken and disorderly behaviour.

The panel ruled: “However, the way you showed such concern for the victim of the assault showed you are a compassionate officer and we saw some of the real PC Muntean.

“We also note the credible references written on your behalf by other officers.

“We also note your remorse throughout the proceedings and the significant stress you have been put under for the last two years.

“We hope you move forward with your policing career with West Midlands Police.”

PC Muntean, who is originally from Romania, had taken West Midlands Police to a tribunal back in 2018, which she had lost.

She had been reprimanded for allegedly parking her patrol car in a disabled bay while buying cakes for colleagues.

But she later lost legal action against her force for race discrimination and victimisation.
